Stepping up of pay of senior PAs of CSSS - Clarification orders issued by DoPT
Subject: Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors.
The undersigned is directed to say that several references have been received in this Department from Ministries/Departments seeking advice as to whether the pay of the senior PAs can be stepped up at par with that of their junior Shri Jai Bhagwan, PA of Department Commerce (Supply Division) (now in Ministry of Information & Broadcasting). It has also come to the notice of this Department that many Ministries/Departments have already granted stepping up of pay to their PAs at par with the pay of Shri Jai Bhagwan.
2. The issue of fixation of pay of Shri Jai ghagwan, PA has been examined in this Department. As per DoP&T’s O.M.No.35034/1/97-Estt.(D) dated 04th October, 2012, stepping up of pay is allowed to those officials who got their ACPS benefit prior no 1.1.2006 but are drawing less pay than their juniors, who got it after 1.1.2006 subject to certain conditions. Therefore, in all similar cases, the stepping up of pay of a particular senior who got the ACPS benefit before 1.1.2006 could only be allowed with direct reference to a particular junior who got it after 1.1.2006 and got his pay fixed in terrns of para 2(c) of Department of Expenditilre’s U.O. note No.10/1/2009-IC dated 14.12.2009. Any stepping up of pay is not allowable in a chain-like manner. Shri. Jai Bhagwall got ACP on 01.07.2005 and as such, para 2(c) of Department of Expenditure’s U.O. note No.10/1/2009-IC dated 14.12.2009 would apparently not apply in his case. As such, the pay fixation order No.G-12014/1/2008-Admn dated 09.02.2011 of Shri Jai Bhagwan, PA issued by the Department of Commerce (Supply Division) is not in order.
3. Ministry of I&B were requested to explore the possibility of allowing stepping up of pay to Shri Jai Bhagwan, in case his case is covered under the O.M. dated 04.10.2012. Accordingly, DAVP, Mintstry of I&B, re-examined his case and re-fixed his pay w.e.f. 01.07.2006 by granting stepping up of pay with reference to his junior namely Smt. Promila Bandooni. A copy of DAVP, M/o I&B’s Office Order No.A.20012/07/2012-Admn.l dated 15.07.201.5 regarding re-fixation of pay of Shri Jai Bhagwan, PA of CSSS enclosed herewith.
4. In view of the above, all Ministries/Departments are advised to take further necessary action to accordingly review the stepping up of pay already granted to their PAs in comparison to Shri Jai Bhagwan, PA, CSSS and necessary recoveries of excess amount, if any, be effected. in this regard, from the concerned officials.

Smt. Promila Bandooni, PA of CSSS cadre of Ministry of Commerce and Industry, Deptt of Commerce (Supply Division) who got he 1st ACP w.e.f. 01.07.2006 in the pay scale of Rs.5500-9000 and fixed as under;
3. The date of next Annual Increment to shri Jai Bhagwan, PA of CSSS cadre will be 01.07.2016, if otherwise admissible.
4. Excess payment, if any______________ made in the form of pay fixation and arrears arising out of the stepping up of pay are subject to recovery in the light of audit objection without further notice.
5. This supersedes all earlier pay fixation orders in respect of Sh.Bhagwan, PA after implementation of the 6th CPC.

After the VII CPC was appointed by Government of India vide notification no.54 Dated 28.02.2014 under the chairmanship of Justice Ashok Kumar Mathur with terms of reference.
The VII Central Pay Commission initially issued a questionnaire and invited replies from all the Federations, Unions, Associations and Government departments. Further invited the memorandum from the respective organisations, Federations and Unions/Associations. Accordingly, the JCM(NC), JCM Constitutents including INDWF jointly prepared the memorandum on pay Structure, Pay determination, Allowances, leave, women issues, LTC, TA/DA and Retirement benefits etc., on 30.06.2014. Subject: Reactivation of PRAN post exit from NPS
PFRDA has been receiving requests from various government nodal offices to reactivate the PRANs for credit of missing NPS contributions, wherein withdrawal requests have already been settled towards final payment to the subscribers.
Currently, the exit process is initiated with the generation of claim ID six months prior to the date of superannuation. As per PFRDA Exit & Withdrawal Regulations 2015, the employee’s and employer’s contributions of last three months prior to superannuation shall not be uploaded in the NPS account but would be credited to the some other account of the subscriber, directly by the employer. During the withdrawal process which stretches over 6 months, both the subscriber and the nodal office have sufficient time to ensure and to confirm that all the missing contributions have been uploaded in the respective PRAN.
In light of the above, PFRDA shall not entertain any such request forthwith, for uploading contributions of arrears/ missing credits after final settlement of exit/ withdrawal of the subscribers and consequent closure of their NPS account. Henceforth, missing credits, if any, should be settled mutually between the subscriber and the Nodal office as per their internal administrative process and outside the NPS architecture, as is currently applicable to last three months contributions before superannuation in line with the guidelines issued by PFRDA in this regard.
Therefore, all government nodal offices are instructed to ensure uploading of all the pending contributions in the PRANs, before initiating/ processing/forwarding the withdrawal requests to the CRA and take necessary action as per this circular.

OFFICE MEMORANDUM
Subject: Central Civil Services (Classification, Control and Appeal) Rules, 1965 — instructions regarding timely issue of Charge-sheet regarding.
The undersigned is directed to refer to DoP&T O.M. of even no. dated 2nd January, 2014 regarding consolidated instructions on suspension and to say that in a recent case, Ajay Kumar Choudhary vs Union of India Civil Appeal No. 1912 of 2015 dated 16/02/2015 the Apex Court has directed as follows:
We, therefore, direct that the currency of Suspension Order should not extend beyond three months if within this period the Memorandum of Charges/ Chargesheet is not served on the delinquent officer/ employee;
2. It is noted that in many cases charge sheets are not issued despite clear prima facie evidence of misconduct on the ground that the matter is under investigation by an investigating agency like Central Bureau of Investigation etc. In the aforesaid judgement the Hon’ble Supreme Court has superseded the direction of the Central Vigilance Commission that pending a criminal investigation departmental proceedings are to be held in abeyance.
3. In this connection, attention is invited to this Department G.M. No. 35014/1/81- Estt.A dated 9.11.1982 which contained the guidelines for timely issue of charge-sheet to Charged officer and to say that these instructions lay down, inter-alia, that where a Government servant is placed under suspension on the ground of “Contemplated” disciplinary proceedings, the existing instructions provide that every effort would be made to finalise the charges, against the Government servant within three months of the date of suspension. If these instructions are strictly adhered to, a Government servant who is placed under suspension on the ground of contemplated disciplinary proceedings will become aware of the reasons for his suspension without much loss of time. The reasons for suspension should be communicated to the Government servant concerned at the earliest, so that he may be in a position to effectively exercise the right of appeal available to him under Rule 23 (i) of the CCS (CCA) Rules, 1965, if he so desires. The time-limit of forty five days for submission of appeal should be counted from the date on which the reasons for suspension arc communicated.
4. All Ministries/ Departments are requested to bring the above guidelines to the notice of all concerned officials for compliance.

CHARTER OF DEMANDS
1. Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.
2. (a) Containing unemployment through concrete measures for employment generation.
(b) No ban on creation of new posts. Fill up all vacant posts.
3. (a) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measure for violation for labour laws. Withdraw the anti-worker Labour Law Amendments
(b) No labour reforms which are inimical to the interest of the workers.
4. (a) Universal social security cover for all workers
(b) Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.
5. (a) Fix minium wage with provisions of indexation.
(b) Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.
6. (a) Stoppage of disinvestment in Central/State PSUs. Stoppage of contractorisation in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.
(b) No outsourcing, contractorisation, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.
7. Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.
8. (a) Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.
(b) Revive the JCM functioning at all level as an effective negotiating forum for settlement of
the demands of the Central Government Employees.
9. (a) Against FDI in Railways, Insurance and Defence.
(b) No Privatisation, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.
10. Remove arbitrary ceiling on compassionate appointment.
11. Ensure five promotions in the serve career.

Pension to Ex-Servicemen
The complaints regarding incorrect payment of pension, incorrect revision/ underpayment of pension etc. are being received and action is taken to redress the grievances by taking appropriate action in coordination with Pension Sanctioning Authorities & Pension Disbursement Agencies.
The number of complaints received during each of the last three years and the current year are as under:-

The Government is considering to implement a system of Central Pension Disbursement Agency (CPDA) to facilitate credit of pension directly to Pensioner’s bank account.The new system is likely to be implemented from the next financial year.
For ensuring quick and seamless disbursement of pension to Ex-Servicemen, following projects are undertaken by the Government.
- Digital life certificate through Jeevan Praman Portal.
- Digitization of records to enable prompt pension revision in future.
- Submission of e-Pension claim and issuance of e-PPO.

1. Shri Nikhilesh Jha, IAS (MN:1984), at present in the cadre, as Mission Director, National Water Mission under the Ministry of Water Resources, River Development and Ganga Rejuvenation (newly created post).
2. Smt. Preeti Madan, IES (1981), Joint Secretary, Ministry of Minority Affairs as Member Secretary, National Commission for Women under the Ministry of Women and Child Development vice Ms. Nandita Chaterjee, IAS (WB:1980).
