Coverage of date of priority for general pool residential accommodation in certain matters such as regularization, calculation of licence fee etc.

G.I., Directorate of Estates, O.M.No.12035/16/2010-Pol.II(Vol.II), dated 23.7.2015

Sub: Coverage of date of priority for general pool residential accommodation in certain matters such as regularization, calculation of licence fee etc.

It has been brought to the notice of the Directorate of Estates that there have been occasions when allotment sections have faced difficulties, after introduction of Automated System of Allotment, on coverage of date of priority for a house in a particular type of accommodation in an area/locality while regularization of general pool residential accommodation or during conversion of three times of licence fee into normal licence fee in out of turn allotment cases etc. Before introduction of Automated System of Allotment waiting lists were prepared area/locality-wise. However, after introduction of Automated System of Allotment, the unified waiting lists are now prepared house-wise in each area/locality which keeps on changing with each bidding cycle. This- results into complexities in calculation of date of priority.

Children of Government servants should study only in Government schools – Allahabad High Court

The Allahabad High Court has issued strict orders that the children of government employees should study only at government schools.
A Public Interest Litigation was filed at the Allahabad High Court stating that in Uttar Pradesh, led by its Samajwadi party Chief Minister Akhilesh Yadav, the government-run schools do not have sufficient teachers. The officials were not taking any steps to improve the standard of education in these schools and infrastructure was poor.
After hearing the arguments, Justice Sudhir Agarwal issued an order, excerpts of which are provided below:
All the government employees shall enroll their children only at government-run schools. The rule is applicable also to the representatives of the people, and the employees of the justice department. The state government can impose penalties to stop them from admitting their children to private schools.
The employees can be made to pay as penalty the sum that they had paid as fees to the private schools. The revenue thus generated can be added to the state exchequer. The Chief Secretary of the state was given six months to submit a report on this reform.

Grant of higher Grade Pay to Fire Engine Drivers

BHARATIYA PRATIRAKSHA MAZDOOR SANGH

New Delhi – 110011

Subject: Grant of higher Grade Pay to Fire Engine Drivers.

Respected Sir,
With due regards, your attention is invited to the structure of Fire Fighting Cadre in AOC which is notified as SRO 93 of 2006 and the hierarchy of this cadre is mentioned below:-

Subsequently, vide ID No. 2(1)/2009-D(Civ-I), dated 26.07.2010, MOD issued instructions for grant of upgraded pay scales to the Fire Fighting Staff as per 6th CPC recommendations which is mentioned below:-
Para 3 of the above MOD ID states that as for the four grade promotional scheme applicable to the civilian drivers as extended to the Fire Engine Drivers, they may continue where they exist at present and in remaining establishments, the posts of Fire Engine Drivers shall be merged with the Fire Fighting Cadre.

This upgradation and merger have disturbed the horizontal parity between Fire Fighting Cadre and Fire Engine Drivers as under:-
To remove this disparity some of the incumbents (FEDs) filed O.A. (No.060/00443/2015) in Central Administrative Tribunal – Chandigarh. On 25.05.2015 the CAT Chandigarh disposed off the O.A. with direction to respondents to take a view on the pending representations of the applicants by passing reasoned and speaking order in accordance with Law and Rules within a period of 03 months.

In such circumstances, you are requested to consider the above in correct perspective and issue necessary instructions so that the horizontal disparity between Fire Fighting Cadre and Fire Engine Drivers may be removed without further delay.

Thanking you.

Cabinet Agrees to Give 4 Months Extension to 7th Pay Commission

“The cabinet has consented to give four more months for the 7th Pay Commission to submit its report.”
Following the request from the 7th Central Pay Commission, the cabinet has given an additional four months’ grace time, according to a government release.
The 7th Pay Commission was constituted on 28.02.2014 by the centre. The 18 months’ time given to the Commission ends today. The Commission has stated that there is excess of pending workload to prepare final report and that they want to intensive consultation with stakeholders. Hence, the cabinet gave a nod to extend the time until December for the Commission to carry out its work.
As a result of this new development, the Commission will submit its report in January 2016.
Rumours and unconfirmed news about this began to circulate since Monday. The meeting of the defence minister and the finance minister with the prime minister held in the week begining onwards. And the Pay Commission’s chairman’s interaction with the prime minister – all these activities led to a lot of speculations.
There were talks that the Prime Minister’s Office was getting ready to make some important announcements regarding the One Rank One Pension scheme.
Until last month, employees were confident that the 7th Pay Commission will submit its report on time. This belief was further strengthened by a series of incidents that took place. Employees are extremely disappointed to hear this announcement.
And, Central Government employees are now wondering what the real reason could be for the sudden delay.

Stepping up of pay of senior PAs of CSSS - Clarification orders issued by DoPT

Subject: Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors.

The undersigned is directed to say that several references have been received in this Department from Ministries/Departments seeking advice as to whether the pay of the senior PAs can be stepped up at par with that of their junior Shri Jai Bhagwan, PA of Department Commerce (Supply Division) (now in Ministry of Information & Broadcasting). It has also come to the notice of this Department that many Ministries/Departments have already granted stepping up of pay to their PAs at par with the pay of Shri Jai Bhagwan.

2. The issue of fixation of pay of Shri Jai ghagwan, PA has been examined in this Department. As per DoP&T’s O.M.No.35034/1/97-Estt.(D) dated 04th October, 2012, stepping up of pay is allowed to those officials who got their ACPS benefit prior no 1.1.2006 but are drawing less pay than their juniors, who got it after 1.1.2006 subject to certain conditions. Therefore, in all similar cases, the stepping up of pay of a particular senior who got the ACPS benefit before 1.1.2006 could only be allowed with direct reference to a particular junior who got it after 1.1.2006 and got his pay fixed in terrns of para 2(c) of Department of Expenditilre’s U.O. note No.10/1/2009-IC dated 14.12.2009. Any stepping up of pay is not allowable in a chain-like manner. Shri. Jai Bhagwall got ACP on 01.07.2005 and as such, para 2(c) of Department of Expenditure’s U.O. note No.10/1/2009-IC dated 14.12.2009 would apparently not apply in his case. As such, the pay fixation order No.G-12014/1/2008-Admn dated 09.02.2011 of Shri Jai Bhagwan, PA issued by the Department of Commerce (Supply Division) is not in order.

3. Ministry of I&B were requested to explore the possibility of allowing stepping up of pay to Shri Jai Bhagwan, in case his case is covered under the O.M. dated 04.10.2012. Accordingly, DAVP, Mintstry of I&B, re-examined his case and re-fixed his pay w.e.f. 01.07.2006 by granting stepping up of pay with reference to his junior namely Smt. Promila Bandooni. A copy of DAVP, M/o I&B’s Office Order No.A.20012/07/2012-Admn.l dated 15.07.201.5 regarding re-fixation of pay of Shri Jai Bhagwan, PA of CSSS enclosed herewith.

4. In view of the above, all Ministries/Departments are advised to take further necessary action to accordingly review the stepping up of pay already granted to their PAs in comparison to Shri Jai Bhagwan, PA, CSSS and necessary recoveries of excess amount, if any, be effected. in this regard, from the concerned officials.

Smt. Promila Bandooni, PA of CSSS cadre of Ministry of Commerce and Industry, Deptt of Commerce (Supply Division) who got he 1st ACP w.e.f. 01.07.2006 in the pay scale of Rs.5500-9000 and fixed as under;

3. The date of next Annual Increment to shri Jai Bhagwan, PA of CSSS cadre will be 01.07.2016, if otherwise admissible.

4. Excess payment, if any______________ made in the form of pay fixation and arrears arising out of the stepping up of pay are subject to recovery in the light of audit objection without further notice.

No.VI/40 1/01/05/2014
Government of India
Ministry of External Affairs
CPV Division
Patiala House Annexe, Tilak Marg
New Delhi, 26th May, 2015
OFFICE MEMORANDUM
Subject: Issuance of Ordinary Passport to Government Servants, PSU/Autonomous body employees, et al.
In tune with the Government’s objective of ‘Minimum Government, Maximum Governance’ and with a view to simplifying the procedure for issuance of Passport to Government Servants, PSU j Autonomous body employees, et al, the matter has been reviewed. In order to facilitate issuance of Passport to Government employees, et al;
who find difficulties to obtain Identity Certificate (IC)/No Objection Certificate (NOC) from their department, it has been decided to introduce a new feature which is termed as ‘Prior Intimation’ letter to the controlling authority by the Passport applicant before submission of a Passport application.
2. Basically, Prior Intimation is a letter from the Passport applicant giving intimation to his/her Controlling I Administrative Authority (employer) regarding submission of Passport application. This can be submitted by the
applicant in the format of ‘Annexure-N’. After submission of Passport application by such an employee, the copy of this Prior Intimation would be sent to the same Controlling/ Administrative Authority under which the employee is working. In case the employer has any objection regarding issuance of Passport to that employee, they may revert back to concerned Regional Passport Office mentioning the details of such objection. However, the final decision will be taken by the concerned Passport Issuing Authority. If Prior Intimation is submitted by the applicant, Passport
would be issued on the basis of Pre-Police Verification, however the provisions of Police Verification in reissue cases will remain applicable.
3. Henceforth, anyone of the following documents can be submitted by Government Servants, PSU/Autonomous body employees, et al. for submission of application for Passports:
(a) Copy of Prior Intimation to Controlling /Administrative Authority; or
(b) No Objection Certificate from Controlling/Administrative Authority; or
(c) Identity Certificate from Controlling /Administrative authority.
4. No Objection Certificate (NOC) is issued in the format of ‘Annexure-M’ by the Controlling /Administrative Authority of the employee working under them for obtaining Passport by any Government Servants, PSU/Autonomous body employees, et al. If NOC is submitted Passport will be issued on Post-Police Verification basis.
5. Identity Certificate (IC) is issued in the format of ‘Annexure-B’ by the Controlling /Administrative Authority of the employee working under them for obtaining Passport by any Government Servants, PSU j Autonomous body employees, et al. If IC is submitted Passport will be issued on No-Police Verification basis. The spouse of such employees, and dependent children up to the age of 18 years, has an option to submit IC for expeditious issue of passport. In case of IC, the applicant is also required to submit ‘Annexure-I’.
6. It may be noted that the following provisions will remain applicable as mentioned below:
a. While IC should be issued preferably on Official Stationery (letterhead); NOC onplain paper with signature/stamp can be accepted, on the assumption that such offices are using plain paper for day to day correspondence. Prior
Intimation (PI) is required to be submitted on plain paper by the Passport applicant.
b. Telephone, fax and e-mail id of the Controlling I Administrative Office (to the extent available) should be indicated in all the three documents for the purpose of confirmation.
c. Military personnel with cj o APO address (e.g. 56 APO /99 APO) may submit applications at their station of posting or at their permanent address, and write their permanent address in passport [against present address otherwise].
Spouse of such personnel [and adult children, when spouse has expired/divorced] may receive the passport, with authority letter, either by hand or by post. This would apply to similarly placed Air Force/Navy personnel as well.
d. If GovernmentjPSU employees, et al. are transferred after submission of the passport application or passport is returned undelivered due to such transfer, the same be re-dispatched, on request (along with copy of transfer order), at the new address, after correction/ endorsement of address. However, if police verification was required and was not completed, it will be done at the new place.
e. The validity of the documents mentioned at para-3 will be six months from date of issue.
7. While the revised prov1s10ns deal only with passport issuance, the requirement by the Government employees to obtain prior permission from his/her Department I Ministry for travelling abroad as per Conduct Rules will remain unchanged as per the instructions issued by the Department of Personnel & Training and respective authorities.
8. Ministries of the Central Government, and the State Governments/ Union Territories are requested to circulate these instructions to all the employees working under them, including those in attached and subordinate ~offices, and statutory bodies.

Reactivation of PRAN post exit from NPS

PFRDA/2015/19/CSG/1
Date: 30th June, 2015
All Central Government Ministries & Departments/ State Governments
PrAOs, PAOs, CDDOs, NCDDOs & other CG Nodal offices;
DTAs, DTOs, DDOs & other SG Nodal offices
Autonomous Bodies
Subject: Reactivation of PRAN post exit from NPS
PFRDA has been receiving requests from various government nodal offices to reactivate the PRANs for credit of missing NPS contributions, wherein withdrawal requests have already been settled towards final payment to the subscribers.
Currently, the exit process is initiated with the generation of claim ID six months prior to the date of superannuation. As per PFRDA Exit & Withdrawal Regulations 2015, the employee’s and employer’s contributions of last three months prior to superannuation shall not be uploaded in the NPS account but would be credited to the some other account of the subscriber, directly by the employer. During the withdrawal process which stretches over 6 months, both the subscriber and the nodal office have sufficient time to ensure and to confirm that all the missing contributions have been uploaded in the respective PRAN.
In light of the above, PFRDA shall not entertain any such request forthwith, for uploading contributions of arrears/ missing credits after final settlement of exit/ withdrawal of the subscribers and consequent closure of their NPS account. Henceforth, missing credits, if any, should be settled mutually between the subscriber and the Nodal office as per their internal administrative process and outside the NPS architecture, as is currently applicable to last three months contributions before superannuation in line with the guidelines issued by PFRDA in this regard.
Therefore, all government nodal offices are instructed to ensure uploading of all the pending contributions in the PRANs, before initiating/ processing/forwarding the withdrawal requests to the CRA and take necessary action as per this circular.

Discipline and Appeal Rules – instructions regarding timely issue of Charge-sheet regarding.

F. No. 11012/17/2013-Fstt.(A)
Government of India
Ministry of Personnel, Public Grievances and Pensions
Department of Personnel & Training
Establishment A-III Desk
*****
North Block, New Delhi — 110001
Dated July 3rd 2015
OFFICE MEMORANDUM
Subject: Central Civil Services (Classification, Control and Appeal) Rules, 1965 — instructions regarding timely issue of Charge-sheet regarding.
The undersigned is directed to refer to DoP&T O.M. of even no. dated 2nd January, 2014 regarding consolidated instructions on suspension and to say that in a recent case, Ajay Kumar Choudhary vs Union of India Civil Appeal No. 1912 of 2015 dated 16/02/2015 the Apex Court has directed as follows:
We, therefore, direct that the currency of Suspension Order should not extend beyond three months if within this period the Memorandum of Charges/ Chargesheet is not served on the delinquent officer/ employee;
2. It is noted that in many cases charge sheets are not issued despite clear prima facie evidence of misconduct on the ground that the matter is under investigation by an investigating agency like Central Bureau of Investigation etc. In the aforesaid judgement the Hon’ble Supreme Court has superseded the direction of the Central Vigilance Commission that pending a criminal investigation departmental proceedings are to be held in abeyance.
3. In this connection, attention is invited to this Department G.M. No. 35014/1/81- Estt.A dated 9.11.1982 which contained the guidelines for timely issue of charge-sheet to Charged officer and to say that these instructions lay down, inter-alia, that where a Government servant is placed under suspension on the ground of “Contemplated” disciplinary proceedings, the existing instructions provide that every effort would be made to finalise the charges, against the Government servant within three months of the date of suspension. If these instructions are strictly adhered to, a Government servant who is placed under suspension on the ground of contemplated disciplinary proceedings will become aware of the reasons for his suspension without much loss of time. The reasons for suspension should be communicated to the Government servant concerned at the earliest, so that he may be in a position to effectively exercise the right of appeal available to him under Rule 23 (i) of the CCS (CCA) Rules, 1965, if he so desires. The time-limit of forty five days for submission of appeal should be counted from the date on which the reasons for suspension arc communicated.
4. All Ministries/ Departments are requested to bring the above guidelines to the notice of all concerned officials for compliance.
