100 Per Cent Salary Hike Only If MPs Devote Full Time To Parliament: Nariman

NEW DELHI: Commenting on the demand of lawmakers demanding 100 per cent hike in their salary, distinguished Indian Constitutional expert Fali Sam Nariman on Saturday said they would be entitled even to 100 per cent salary increase, provided that they gave all their time to Parliament.

"In England, Parliament sits throughout the year, except for a few weeks here and there, because there is no provision, in England or in America, for an ordinance. In India, we have under our constitution, a provision for an ordinance, which is lawmaking during recession of Parliament, and that is why our Parliament only sits for 80, 90 or 100 days in a year," he said.

The said letter of yours though has not been received by us. But the undersigned has come to know about it through one of BPS affiliate on date i.e. 15.12.2015. Accordingly undersigned submits BDPA (INDIA) views on the Pension/Retirement benefits as follows:

There are various reports in the media about the impact of the 7th CPC recommendations on the common man and the government resources at large, the reports suggest that additional amount of Rs one lakh crores of public money has been spent for implementation of the 7thCPC recommendations for 35 lakhs central Government employees, Perhaps the strongest criticism of Pay Commission awards is that they play havoc with government finances and also state government demand support to implement the 7th CPC recommendations. At the aggregate level, these concerns are somewhat exaggerated and which is totally wrong.

नई दिल्ली। लोकसभा ने मंगलवार को बोनस की पात्रता सीमा 10,000 रुपये मासिक वेतन से 21,000 रुपये करने और उसकी गणना की सीमा 3,500 से 7,000 रुपये करने के प्रावधान वाले विधेयक को ध्वनिमत से पारित कर दिया। अगले सत्र में इसके राज्यसभा से भी पारित होने की प्रबल संभावना है। जिसके बाद यह कानून की शक्ल ले लेगा।

इससे पूर्व केंद्रीय श्रम मंत्री बंडारू दत्तात्रेय ने बोनस भुगतान (संशोधन) विधेयक, 2015 पर हुई चर्चा का जवाब देते हुए कहा कि इस बिल के कानून बनने पर उसे एक अप्रैल, 2014 से लागू माना जाएगा। श्रम मंत्री ने कहा कि सरकार श्रमिकों के वेतन, रोजगार और सामाजिक सुरक्षा सुनिश्चित करेगी। कामगारों के अधिकारों का कोई उल्लंघन नहीं होगा। सरकार उनके हितों के लिए काम करेगी।

Lok Sabha during next week will take up The Payment of Bonus (Amendment) Bill, 2015 – PIB Report

As Winter session enters final lap, Rajya Sabha to take up some pending Bills
18 Bills with allotted discussion time of over 43 hours on unfinished agenda for Rajya Sabha
Upper House to discuss role of Arunachal Pradesh, price rise
Lower House to take up Payment of Bonus and National Waterways Bills
12 Bills passed and 6 introduced in Lok Sabha during this session so far; 1-0 in Rajya Sabha
                With only 3 sittings left next week for the current Winter session of Parliament and hardly any legislative business transacted in Rajya Sabha so far, the All Party meeting convened by the Chairman of Rajya Sabha on Friday this week raised the prospects of passage of some of the pending Bills in the Upper House during the remainder of this session.
                A total of 18 Bills for which the Business Advisory Committee of Rajya Sabha has allotted a total of 43.50 hours for discussion is on the unfinished agenda of the House. Of these, the House is likely to take up The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Bill, 2015, The Arbitration and Conciliation (Amendment) Bill,2015, The Atomic Energy (Amendment) Bill,2015, The Appropriation Bills pertaining to Supplementary Demands for Grants (General) for 2015-16 and Excess Demands for Grants (General) for 2012-13, all passed by the Lok Sabha during this session and The Whistle Blower Protection (Amendment)  Bill,2015, The Juvenile Justice (Care and Protection of Children) Amendment Bill,2015, as passed by the Lok Sabha earlier and The Child Labour (Protection and Regulation) Amendment Bill,2012, on which the Standing Committee presented its Report in December,2013.
                Rajya Sabha is also likely to discuss next week the role of Governor of Arunachal Pradesh as agreed to by the Government at the All Party Meeting besides growing intolerance endangering the unity and diversity of the country and prices of essential commodities and food grains.
                Lok Sabha during next week will take up The Payment of Bonus (Amendment) Bill,2015 and The National Waterways (Amendment) Bill,2015 for which discussion time of 2 and 3 hours respectively has been allotted.
                Besides, the Lower House will take up short duration discussion on the situation in Nepal and the State of Indo-Nepal relations and resume discussion on Sustainable Development Goals, which was part discussed during the last session.
Work done during Winter session so far
                During the current Winter session that commenced on November 26th, 12 Bills have been passed  by Lok Sabha while 6 new Bills have been introduced.
                Bills Passed were : The Carriage by Air (Amendment) Bill,2015, The Bureau of Indian Standards Bill,2015, The High Court and the Supreme Court Judges (salaries and Conditions of Service) Amendment Bill,2015, The Indian Trustees(Amendment)  Bill,2015, The Industries (Development and Regulation) Amendment Bill,2015, The Negotiable Instruments (Amendment) Bill,2015, The Atomic Energy (Amendment) Bill,2015, Discussion and Voting on Supplementary Demands and Excess Demands for Grants and the related Appropriation Bills, The Sugar Cess (Amendment) Bill,2015, The Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts (Amendment) Bill,2015 and The Arbitration and Conciliation (Amendment) Bill,2015.
                All the 6 new Bills introduced relating to arbitration and conciliation, commercial jurisdiction of High Courts, atomic energy, payment of bonus to workers, industries and sugar cess were passed by the Lok Sabha.
                Lower House held two day special discussion on commitment to the Constitution the occasion of 125th Birth anniversary of Dr.BR Ambedkar besides taking up issues of intolerance, floods in Tamil Nadu and Andhra Pradesh, drought situation in the country and price rise.
                Three suo-moto statements were made in the house by the concerned ministers regarding the visit of External Affairs Minister to Islamabad, initiatives relating to road transport and highways for regional connectivity with focus on North-East and climate change.
                On the other hand, Rajya Sabha passed only Bill pertaining to Negotiable instruments while no new Bills were introduced in the House during the ongoing winter session so far.
                The Upper House discussed commitment to the Constitution, floods in Tamil Nadu and Andhra Pradesh and Indo-Nepal relations. External Affairs Minister made a  suo-moto statement on her visit to Islamabad.

CBEC’s ACES Software Mired In ‘Skewed Utilisation': CAG

NEW DELHI: Flagging the issue of "skewed utilisation" of ACES software deployed by CBEC to improve efficiency of indirect tax administration, the Comptroller and Auditor General of India today said no review of the application was done even after five years of implementation. 

The Automation of Central Excise and Service Tax (ACES) software was initially rolled out at the Large Tax Payer Unit Commissionerate in Bengaluru in December 2008 and subsequently implemented across the countr ..

Subject: Recommendations of the 7th Pay commission relating to pension/Retirement Benefits 

Ref: Your office letter No.38/66/13-P&PW(A)(Vol.II) dated 1st/3rd December, 2015.

We would like to draw your kind attention to the following major points of serious injustice with the pensioners, with a request for justice and required relief for the pensioners:

1. FIXED MEDICAL ALLOWANCE (Ref: Para 8.17.51): It is regretted that the 7th CPC has recommended no enhancement of Fixed Medical Allowance (FMA) for pensioner for day to day medical treatment not requiring hospitalization, merely on the ground that ” this Allowance was last enhanced from Rs.300 to Rs.500 pm from 19-11-2014.

जिस दिन आएंगे ऑफिस, तभी से होगी वेतन में बढ़ोतरी

नई दिल्ली। जस्टिस एके माथुर की अध्यक्षता वाले सातवें वेतन आयोग ने केंद्र सरकार को अपनी सिफारिशें सौंप दी हैं। इस पर सरकार ने अमल करना भी शुरू कर दिया है। आयोग ने सिफारिश की है कि 1 जनवरी 2016 से सरकारी कर्मचारियों को आयोग की सिफारिशों के अनुसार बढ़ा हुआ वेतन दिया जाए।
यह भी कहा कि अगर कोई कर्मचारी 1 जनवरी 2016 को किसी कारणवश या छुट्टी की वजह से ऑफिस नहीं आता है, तो आयोग की सिफारिशों के मुताबिक बढ़ा हुआ वेतन एक तारीख से नहीं दिया जाए। हर सरकारी कर्मचारी को बढ़ा हुआ वेतनमान उस दिन से मिलेगा, जिस दिन से वो साल 2016 में ऑफिस ज्वाइन करेगा।
कम से कम वेतन 18 हजार महीना
63% बढ़ेंगे भत्ते।
16% मूल वेतन में वृद्धि।
03% सालाना वेतन वृद्धि।
18 हजार न्यूनतम मासिक वेतन।
2.5 लाख अधिकतम मासिक वेतन यानी केबिनेट सचिव को इतना वेतन मिलेगा, बाकी शीर्ष अफसरों का वेतन 2.25 लाख होगा।
10 लाख से बढ़ाकर 20 लाख हो ग्रैच्युटी। डीए 50 फीसदी बढे़ तो ग्रैच्युटी 25 फीसदी बढे़।
7.5 लाख से 25 लाख तक का घर खरीदने के लिए बिना ब्याज एडवांस।
पैरामिलिट्री के जवान या अफसर की ड्यूटी के दौरान मौत पर शहीद का दर्जा मिले।
एक सैलरी, एक पोस्ट का नियम लागू हो।
52 तरह के भत्ते खत्म हों। पे बैंड और ग्रेड पे खत्म हो।
ग्रुप ए अफसरों को आईएएस के बराबर वेतन मिले।

58 Bureaucrats Penalised For Unsatisfactory Performance: Govt




NEW DELHI: As many as 58 bureaucrats faced penalty, including dismissal from services, compulsory retired and pension cut, for unsatisfactory performance, the government said today.

Minister of State for Personnel, Public Grievances and Pensions Jitendra Singh told Lok Sabha in a written reply, "From May 2014 till today, 13 Central Civil Service or All India Service officers have been dismissed, removed or compulsory retired from government service and penalty of pension cut have been imposed on 45 others."

No Proposal To Reduce Retirement Age To 58 Years: Govt

New Delhi  (PTI) There is no proposal to reduce retirement age to 58 years of age or 33 years of service for central government employees, the Centre said today.

There are about 50 lakh central government employees.

"No such proposal is under consideration," Minister of State for Personnel Jitendra Singh told Lok Sabha in a written reply.

CBI Arrests Joint Commissioner Income Tax



Mumbai: The Central Bureau of Investigation (CBI) on Friday apprehended a Joint Commissioner of Income Tax Department here for allegedly accepting a bribe of Rs 5 lakh.

As per a CBI official, SK Jhangre was arrested from his Mumbai office. The probe agency registered a case on a complaint that Jhangre threatened to re-open the firm`s Income Tax assessment files.

"The joint commissioner also threatened the CA (chartered accountant) of the complainant, and said he (the firm`s owner) should come and meet him for settling the Income Tax matter," said a CBI official, as per IANS.

Financial Impact & Benefits of National Pension Scheme (NPS)

The National Pension System (NPS) has been designed giving utmost importance to the welfare of the subscribers under NPS. There are a number of benefits available to the employees under NPS. Some of the benefits are enlisted below: 

• NPS is a well designed pension system managed through an unbundled architecture involving intermediaries appointed by the Pension Fund Regulatory and Development Authority (PFRDA) viz, pension funds, custodian, central record keeping and accounting agency, National Pension System Trust, trustee bank, points of presence and annuity service providers. It is prudently regulated by PFRDA which is a statutory regulatory body established to promote old age income security and to protect the interests of subscribers of NPS.

7th Pay Commission recommendations on Bonus Schemes

Bonus Schemes in the Central Government : Apart from DAE/DoS, there are bonus payments to Group `B’ (non-gazetted) and Group `C’ Central Government employees. The bulk of these employees are covered under the Productivity Linked Bonus (PLB) Scheme, which is implemented in Railways, Posts and Telecommunications, production units under the Ministry of Defence and other establishments


The system of Performance Linked Bonus (PLB) and Ad hoc Bonus have been prevalent in the Central Government for a fairly long time. Therefore, for the replacement of the existing bonus schemes with any other incentive scheme, prior consultation with the stakeholders was considered essential.

The Commission notes that since PRIS could not be implemented, it could not supplant the existing system of Performance Linked and Adhoc Bonus Schemes.


The Commission also recommends that the PRP should subsume the existing Bonus schemes. The Commission notes that there could be a time lag in implementing the Performance Related Pay by different departments. Till such time, the existing Bonus Schemes should be reviewed and linked with increased profitability/productivity under well-defined financial parameters


The Commission feels that there is strong need to create a culture of performance in government – from establishing standards of performance, to measuring, and promoting people based on performance. To emphasize on the culture of performance, the Commission has recommended that all the non-performers in the system should be phased out after 20 years.


The Commission has recommended that Performance Related Pay should be introduced in the government and that all Bonus payments should necessarily be linked with productivity.

Sub: Inviting comments on the proposed Recruitment Rules to the posts of Data Entry Operator Grade 'E' (Grade Pay Rs 4600) and Data Entry Operator Grade 'F' (Grade Pay Rs. 4800).

Indian Audit and Accounts Department proposes to frame Recruitment Rules (RRs) for the posts of Data Processor (Grade Pay Rs. 4600) and Senior Data Processor (Grade Pay Rs. 4800) hereinafter referred as Data Entry Operator Grade E' and Data Entry Operator Grade 'F'. The proposed RRs containing draft Notification and Schedule given/posted below have been framed in accordance with the Model RRs, circulated by the DoP&T Vide OM N o AB-14017/2/2011-Estt (RR) dated 30.05.2014 and supplementary instructions circulated Vide OM No. No.AB-14017/2/2011-Estt (RR) dated 10.12.2014.

2. In terms of DoP&T OM No AB-1401 7/61/2008-Estt.(RR) dated 13.10.2015, comments on the proposed Notification and Schedule of Recruitment Rules are invited from all stake holders in the following format :

Metro Rail Scam: Ex-IAS Officer Sanjay Gupta Gets Interim Bail

Former IAS officer Sanjay Gupta was today granted interim bail of one week on health grounds by the Gujarat High Court as well as Gandhinagar court in two separate graft cases in connection with Ahmedabad-Gandhinagar Metro rail scam.
While hearing his bail plea today, HC justice A J Desai granted interim bail to him till December 14. Gupta had sought interim bail on the grounds that he needed urgent medical treatment for his lever-related ailment.

In May this year, Gujarat CID arrested Gupta, who had served as Executive Chairman of state-owned Metro-Link Express for Ahemdabad and Gandhinagar (MEGA) company, alleging that financial irregularities to the tune of Rs 113 crore had taken place during his tenure in MEGA in 2012.

Office Memorandum

Subject: Implementation of e-service book in all Ministries/Departments.

The Service Book of a Government servant is a document to record all the events in his/her entire service period and career recording each and every administrative action of the Government servant right from the stage of his recruitment till his retirement to reflect: the history of. service of a Government employee. As per SR 198 & 199 such a Service Book is to be maintained for a Government servant from the date of his/her first appointment and is required. to be kept in the custody of the Head of Office in which he is serving and transferred with him from office to office.

2. It has been decided. to switch over to electronic format for maintenance of Service Book. The e-Service Book module is presently available under the e-office Mission Mode Project. The data entered in e-service book is available to the employees to enable them to cross-check and report any discrepancies. The. Controller General of Accounts (CGA) was requested to accept e-service book as a legal tender. The CGA has agreed to accept the e-service book as legal tender for all purposes and accordingly issued instructions to all Controllers of Accounts.

3. All Ministries / Departments are advised to adopt the e~service book as the same will be treated as legal tender for all purposes.

Respected Sir,
With due regards, it is submitted that this federation has gone through the recommendations of 7th CPC and found that the recommendations are very disappointing. It appears that the 7th CPC has not considered the genuine demands of the OFB in correct perspective. Hence, OFB is requested to examine the following matters related to the Cadres:-
1. Industrial Cadre:-
(i) BPMS has demanded that the Grade Pay of Skilled employees should be enhanced from Rs. 1900/- to Rs. 2400/-.
(ii) Further, Highly Skilled Gr-II in GP 2400/- and Highly Skilled in GP 2800/-should be merged in a single GP of Rs. 2800/-
(iii) Inter Grade ratio should be same in MOD, Railways & other ministries which is as under in Railways-
Skilled – 20%
Highly Skilled – 64% (HS-II 20%, HS-I 44%)
Master Craftsman – 16%
(iv) To retain the experienced employees in industrial cadre without financial hardships, it has been demanded that Master Craftsman may be promoted to MCM (Selection Grade) in the same GP of Junior Works Manager.
2. Supervisory Staff:-
(i) BPMS has demanded that the Grade Pay of Junior Works Manager should be upgraded from Rs. 4600/- to Rs. 4800/- so that after completion of 04 yrs regular service incumbents may be placed in the GP 5400/-.
(ii) Inter Grade ratio (Chargeman & JWM) should equal for Technical, Non-Technical & Store Cadre.
3. Clerical Cadre:-
(i) BPMS has demanded that the Grade Pay of LDC should be upgraded from Rs. 1900/- to Rs. 2400/- at par with Skilled.
(ii) BPMS has demanded that the Grade Pay of UDC should be upgraded from Rs. 2400/- to Rs. 2800/-.
(iii) BPMS has demanded that the benefit of Non Functional Upgradation to 30% UDC in Secretariat in GP 4200/- on completion of 05 yrs should be extended to the UDCs posted in the Subordinate Offices/Establishments.
4. Store Keeping Cadre:-
(i) BPMS has demanded that the Grade Pay of Store Keeper should be upgraded from Rs. 1900/- to Rs. 2400/- at par with Skilled / LDC.
(ii) BPMS has demanded that the Grade Pay of Supervisor should be upgraded from Rs. 2400/- to Rs. 2800/- at par with UDC / HS.
5. Stenographers Cadre:-
(i) BPMS has demanded that the Grade Pay of Stenographer should be upgraded from Rs. 2400/- to Rs. 2800/- at par with UDC / HS.
(ii) BPMS has demanded that the benefit of Non Functional Upgradation to 30% Steno GM!! in Secretariat in GP 4200/- on completion of 05 yrs should be extended to the Stenographers posted in the Non-Secretariat/Subordinate Offices/Establishments.
6. Fire Fighting Cadre:-
(.) Recommendations of 6th CPC on Fire Fighting Cadre have not been implemented in OFB at par with other Directorates of MOD. 07 CPC has recommended in Para 7.7.24 for drafting of Model Recruitment Rules for the Firefighting Staff of all Central Government Departments and UTs with similar designation and pay structure.
7. Motor Transport Cadre:-
(i) 07th CPC has stated in Para 7.7.16 that Ministry / Departments maycreate supervisory posts as Motor Transport Officer, Transport Supervisor, depending upon the Cadre strength and functional justification. Hence, OFB should create the post of Transport Officer & Motor Transport Officer.
8. Multi Tasking Staff (MTS):-
(i) Contrary to the recommendations of 07th CPC mentioned in Para 7.7.37,BPMS demands that promotional quota should be enhanced from existing 5% and non-functional upgradation at promotional level should be granted to MTS.
9. Hospital Staff:-
(i) Laboratory Technicians: As per 07th CPC recommendations, OFB/MOD should take appropriate action for aligning the Laboratory Staff in the line of cadre structure finalized by Ministry of Health & Family Welfare.
The existing incumbents not possessing the revised qualification (BSc plus DMLT) may be granted the Grade Pay of Rs. 4200/- w.e.f. 01.01.2006 if they have completed 05 yrs regular service.
Considering their job requirement, the incumbents should be granted Conveyance Allowance for visiting Pathology Laboratory outside of the normal duty hours.
(ii) Radiographers: The existing hierarchy of Radiographers in Ministry of Health & Family Welfare (as mentioned in Para 7.6.88 of 07th CPC) should also be implemented in OFB.
(iii) Pharmacist: 07th CPC has mentioned in Para 7.6.102 that sufficient justification does not exist to upgrade the pay levels scales of Pharmacist.
Considering the proper justification annexed with this letter, the Entry Grade Pay of Pharmacist should be upgraded to Rs. 4200/-. The Existing hierarchy of Pharmacists in Ministry of Railways / Ministry of Health & Family Welfare should also be implemented in OFB.
(iv) Medical Assistant: Dressers of Ministry of Railways are equivalent to Medical Assistant of OFB. 07th CPC has recommended (in Para 7.6.108) that entry level qualification of Dressers is Class XII with 03 yrs experience of dressing of wounds. Hence, a higher Grade Pay of Rs. 2000/- from Rs. 1800/- would be granted to the incumbents. It further states that the existing incumbents not possessing the revised qualification may be granted the replacement pay level for the time being but on completion of 05 yrs regular service in GP 1800, they may be granted the GP of Rs. 2000/-. This should also be implemented for Medical Assistant in OFB.
(v) Mid Wife: The entry level qualification of Mid Wife is 10+2 or equivalent with Science and 02 yrs Auxiliary Nursing Mid Wife Course and must have working knowledge of computers as per SRO 88, dated 03.08.2005. The 05th CPC has recommended the pay scale of Rs. (4000-6000) but it has not been granted to the incumbents in OFB. Hence, the existing incumbents not possessing the revised qualification may be granted the Grade Pay of Rs. 2400/- w.e.f. 01.01.2006 if they have completed 05 yrs regular service.
10. Security Staff:
(i) The existing hierarchy of Security Staff in Department of Atomic Energy (as mentioned in Para 11.2.18 of 07th CPC) or Security Staff in DRDO under Ministry of Defence (as mentioned in Para. 11.12.129 of 07th CPC) should also be implemented in OFB.

11. Rajbhasha Cadre:
(i) The 07th CPC has mentioned in Para 11.22.126 that the incumbents of Rajbhasha Cadre has demanded for creation of new posts, merger and upgradation of existing posts and re-designation of various posts with upgraded pay scales but the Commission is not dealing with issues relating to cadre restructuring.
ii) However, considering the stagnation in the Official Language Cadre in OFB, number of posts of Senior HindiTranslators and Assistant Director/Official Language / Hindi Officer should be equated to provide adequate promotional prospects to them.
12. EDP Staff:
(i) Senior Data Entry Operators may be merged with Chargeman (Tech) and this cadre may be abolished.
13. Canteen Staff:
(i) Though 07th CPC has not upgraded the Grade Pay of this cadre, however, OFB should prepare a Cadre Review so that Canteen Employees may be promoted and stagnation may be rmoved.
