Motorola employees demand better compensation

Motorola Mobility employees in Nanjing, Jiangsu province, said on Wednesday that they will not sign employment termination agreements until the company approves revised compensation packages.

A staff member surnamed Zhang, from Motorola's Nanjing Software Center, said the company has asked employee representatives to file new compensation demands.

Motorola's Asia-Pacific president, Liu Fei, who is in Nanjing for negotiations, refused the employees' previous request to delay the center's closure.

I am directed to say that references from various State Governments regarding anomalies in the pay of senior members of All India Services vis-a-vis pay of their juniors in the cadre who have been promoted to the Service or to a higher grade in the Service subsequent to the seniors, have been engaging attention of this Department.

2. The matter has been examined with reference to the existing instructions of the Government on this subject and it is stated that such anomalies on account of fixation of pay on promotion, including the promotion from State service to All India Services, can be solved by stepping up the pay of the senior member of Service at par with the pay of the junior in the cadre from the date when the anomaly arose, subject to fulfilment of following conditions:

Cut payout, or no bailout: govt to Air India

The bleeding national carrier Air India is likely to face bailout blues if it does not stop paying performance-linked incentive (PLI) to employees. The government-appointed oversight committee monitoring the implementation of AI’s turnaround plan (TAP) has threatened to stop further equity infusion into the ailing carrier if it does not stop PLI to it staff.

For employees like pilots and engineers, PLI constitutes around 70% of the salary

The government has committed Rs. 30,000 crore of taxpayers’ hard-earned money, to be paid in tranches till 2020, to keep the debt-laden carrier flying.

Equity infusion is tied to milestones achieved by the airline,” a senior government official said.

“The foremost condition of the TAP, approved by the Cabinet, was freezing of PLI till the airline turns profitable. This hasn’t happened till now.”

The oversight committee, which includes secretary (expenditure), SBI chairman, aviation secretary, AI CMD, had met last week.

“RS Gujral, secretary, expenditure, chaired the meeting,” a source said.

A senior AI official said they were hopeful of convincing the panel to release the next tranche of equity when it meets next.

“The Justice Dharmadhikari Committee that was formed to sort out integration issues in AI had recommended that the company should continue paying PLI,” the official argued.

Aviation ministry officials said the Cabinet’s decision was sacrosanct.

“It was the Cabinet that cleared equity infusion,” said an official.

“It had set certain conditions for release of money and stopping PLI was foremost. Dharmadhikari panel only made recommendations. They are not binding on the government.”

MP govt approves 7 % hike in DA of employees

Bhopal, Aug 28 (PTI) In a major decision, the Madhya Pradesh Government today approved seven per cent hike in the dearness allowance (DA) of its employees. The decision to pay additional DA and other allowances as recommended by the Agrawal Pay Commission was approved by the state Cabinet at its meeting chaired by Chief Minister Shivraj Singh Chouhan, official sources said. With this decision, the employees and the pensioners will get 65 per cent DA with effect from August 1, 2012, they said. The seven per cent rise in DA will put an annual additional burden of Rs 1056.72 crore on the state exchequer while this year it would be around Rs 616.42 crore. The state cabinet also approved other allowances like HRA, transport allowance, daily allowance, meal allowance, travelling allowance and hotel allowance, the sources added. PTI MAS NSK SRE

1. What is Modified Assured Career Progression Scheme (MACPS) ?
The MACP Scheme for Central Civilian Government Employees is in supersession of earlier ACP Scheme. Under the MACP Scheme three financial Up-gradations are allowed on completion of 10,20,30 years of regular service, counted from the direct entry grade. The MACPS envisages merely placement in the immediate next higher grade pay as given in Section I, Part-A of the first schedule of the CCS (Revised Pay) Rules 2008, in case no promotion has been earned by the employee during this period.

2. From which date the MACPS is effective?
The MACPS is effective w.e.f. 01.09.2008 or on completion of 10, 20 & 30 years of continuous regular service, whichever is later. Financial upgradation will also be admissible whenever a person has spent 10 years continuously in the same grade pay. (Para 9 of OM dated 19/5/2009)

3. Who are entitled for financial under the MACPS?
The MACPS is applicable to all Central Government Civilian Employees.

4. What norms are required to be fulfilled while granting the benefits under MACPS?
The financial upgradation would be on non-functional basis subject to fitness in the hierarchy of pay band and grade pay within PB- 1. Thereafter, only the benchmark of ‘Good’ would be applicable till the grade pay of Rs.6600 In PB-3. The benchmark will be ‘Very Good’ for Financial upgradation to the grade pay of Rs.7600 and above. However, where the Financial upgradation under the MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in para 17 of the Scheme, the benchmark for promotion shall apply to MACP also.

5. Whether Pay Band would be changed at the time of grant of financial upgradation under MACPS?
Yes.

6. Whether the promotions in same grade would be counted for the purpose of MACPS?
The financial up-gradation under the MACPS is in the immediate next higher grade pay in the hierarchy of recommended revised pay bands and grade pay as given in CCS (Revised Pay) Rules, 2008. However if the promotional hierarchy as per recruitment rules is such that promotions are earned in the same grade pay, then the same shall be counted for the purpose of MACPS.

7. How will the benefits of ACP be granted if due between 01 .01.2006 and 31.08.2008?
The revised pay structure has been changed w.e.f. 01.01.2006 and the benefits of ACPS have been allowed till 31.08.2008. Hence, the benefits of revised pay structure would be allowed for the purpose of ACPS.

8. Whether adhoc appointment would be counted towards qualifying service for MACPS?
No. Only continuous regular service is counted towards qualifying service for the purpose of MACPS. The regular service shall commence from the date of joining of a post in direct entry grade on a regular basis. (Para 9 of the MACPS)

9. Whether State Government service shall be reckoned for the purpose of MACPS?
No. Only regular service rendered in the Central Government’s Department/Office is to be counted for the purpose of MACPS, as the Scheme is applicable to the Central Government Civilian Employees only. ( MACPS , Para 10)

10. What are the periods included in the regular service?
All period spent on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority shall be included in the regular service. (Para 11. MACPS)

IBA releases DA and DR orders for Bank Employees

Indian Banks’ Association circulated to all member banks regarding that increase of Dearness allowance and Dearness Relief to their employees and pensioners. Existing employees and officers will get at the revised rate of 70.20% of dearness allowance from August to October 2012. The pensioners, according to their period of retirement revised percent has been declared in various parts. Who have retired on or after 1.11.2007, they will be paid 70.20% of their basic pension as dearness relief with effect from August 2012 to January 2012.

Central Civil Services (Leave) (Third Amendment) Rules, 2012.

G.S.R..... - In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules. 1972, namely:-

1. (1) These rules may be called the Central Civil Services (Leave) (Third Amendment) Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.


2. In the Central Civil Services (Leave) Rules, 1972, (hereinafter referred to as the said rules), in rule 43-AA, the existing “Note” shall be numbered as “Note I” and after Note 1 as so renumbered, the following note shall be inserted, namely:-

Note 2:- “Child for the purpose of this rule will include a child taken as ward by the Government servant, under the Guardians and Wards Act, 1890 or the personal law applicable to that Government servant, provided such a ward lives with the Government servant and is treated as a member of the family and provided such Government servant has, through a special will, conferred upon that ward the same status as that of a natural born child’.

3. In the said rules, in rule 43-B, the following note shall be inserted, namely:-

2. In the Central Civil Services (Leave) Rules, 1972, for rule 12, the following rule shalt be substituted, namely:-

"12.(l) No Government Servant shall be granted leave of any kind for a continuous period exceeding five years.

(2) Unless the President, in view of the exceptional circumstances of the case, otherwise determines, a Government servant who remains absent from duty for a continuous period exceeding five years other than on foreign service, with or without leave, shall be deemed to have resigned from the Government service:

Provided that a reasonable opportunity to explain the reasons for such absence shall be given to that Government servant before provisions of sub-rule (2) are invoked”.

Subject:- Grant of Ad-hoc Bonus to the State Government Employees and some other categories of Employees for he year 2011-2012.
The undersigned is directed by order of the Governor to say that the Governor is pleased to decide that the State Government employees who are not covered by any of the productivity Linked Bonus Scheme and whose revised emoluments did not exceed ` 22,000/- per month as on 31st March, 2012 will be entitled to ad-hoc bonus for the accounting year 2011-2012 at the rate of ` 2,500/- per head. The upper eligibility ceiling of ` 22,000/- p.m. as on 31st March, 2012 will be applicable irrespective of whether the emoluments are drawn in the pre-revised or revised scale of pay or on fixed/consolidated contract pay.

One Rank One Pension: No end to ex-servicemen's agony

New Delhi: The Prime Minister-appointed pay panel is unlikely to accept the ex-servicemen's demand of One Rank One Pension (OROP). Sources say that the government could agree to modified parity. The committee which is still to submit its report to the Prime Minister has already met the three service chiefs.

The nitty-gritties of the One Rank One Pension would be clear if we look at one Army family that had two generations serving the nation at two different periods for the same length of time in the same capacity as Havaldar, and yet earning two different pension figures.

Rajesh Kumar, an Army man, lives just about 200 kilometre from the capital in the village of Beri. A small family of three, his father too served in the Indian Army.

Havaldar Zile Singh is the veteran of two wars. He spent 16 years 27 days in the Army, retiring in 1977. Meanwhile, Havaldar Rajesh Kumar saw no wars but served in several conflict zones. He spent nearly the same time - 16 years 10 months - in the force and retired in 2009.

Roughly the same time in service, roughly the same hardships, but the father earns Rs 7,304 as pension, while Rajesh earns Rs 10,736. It's this difference, between a pre-96 retiree and a post-2006 retiree that is at the heart of the conflict and the demand for One Rank One Pension.

One Rank One Pension means two military persons who retired after equal service in the same rank, get equal pension, irrespective of time span separating their retirement date.

Sources, however, say that the government-appointed pay panel is unlikely to agree to this demand. Instead, it may offer modified parity which simply means that for purposes of pension, pay grades will be fixed.

Enhancement of widows' pension, fixing of common scales for all Junior Commissioned Officers (JCOs) and and other ranks (ORs) and the grant of non-functional upgradation may also get the green signal.

The pay panel has met the three service chiefs for their inputs, after repeated warnings that the issue of pay and pension was leading to a whole lot of restlessness among the forces.

Many say, naturally so. For instance: A sepoy who retired in 1995 will get a pension which is roughly 80 per cent less than his counterpart who retired on or after after January 1, 2006.

Worse, three Havaldars with exactly the same length of service could earn different pensions if one retired before 96, the second before 2006 and the third post-2006.

The financial aspect apart, the pay panel has also been told that this one issue was leading to organisational problems, especially in areas where the Army men were working in close co-ordination with his civilian counterparts.

The pay panel's deliberations are still work in progress and the hope is that by Independence Day, the government will have a gift for its men in uniform.

Subject:- Clarification on the admissibility of House Rent Allowance to the Central Government Employees posted at Greater Noida — regarding.
It has been observed that payment of HRA @ 30% of Basic Pay is being made by certain Ministries/Departments to the Central Government employees posted at Greater Noida, in violation of the instructions issued by this Ministry in this regard, from time to time.
2. It is, therefore, clarified that Greater Noida was an Unclassified’ town/place for the purpose of grant of HRA prior to 01/09/2008 and consequent upon the implementation of the recommendations of the 6th Central Pay Commission. it has been classified as ‘Z’ class town/place w.e.f. 01/09/2008 vide this Ministry’s O.M. No. 2(13)/2008-E-II(B) dated 29/08/2008 on grant of House Rent Allowance to the Central Government employees and classification of cities/towns for this purpose.
3. Financial Advisers of All Ministries/Departments are, therefore, requested to ensure the implementation of the aforesaid O.M. in letter & spirit

MEMORANDUM
In terms of rule 12 of the W.B.S.(ROPA) Rules, 2009 the arrears of pay to which a State Government employee is entitled to during the period from the 1st April, 2008 to 31st March, 2009 shall be paid in cash in three consecutive equal yearly instalments beginning from the year 2009-2010.

2. Accordingly in terms of Memo Nos. 3950-F dt. 27.05.2009. 7189-F(P), dt. 02.07.2010 and 8270-F(P), dt. 23.08.2011 the first, the second and the first 50% of the third instalment of arrear calculated as per item No.6 of this Department's Memo No.2728-F, dt. 07.04.2009 were released to the State Government employees on and from 1st August, 2009, 1st August, 2010 and 1st August, 2011 respectively.
3. Now, the undersigned is directed by order of the Governor to state that remaining 50% of the third instalment of arrear already calculated as per item no.6 of this Department's Memo No.2728-F, dated 07.04.2009 will be paid to the State Government employees in the month of September, 2012.

Central Government Health Scheme

Senior citizens and retired personnel who have worked in Central Government bodies are assured of their health care needs through the Central Government Health Scheme or CGHS. This scheme for pensioners provides medical assistance to retired central government officials along with their dependents, freedom fighters and widows of government officials. The CGHS Scheme also covers Delhi police personnel, retired judges of the Supreme Court, Parliament secretaries and their families.

Shivraj govt's Independence Day bozanza for employees; Fly high

BHOPAL: Madhya Pradesh state government employees have more reasons to celebrate this Independence Day with gusto. They just got a pay hike and many would now have the privilege to fly for official work. Previously, only officers of the rank of secretary and above were entitled for air travel.

Now, employees with a basic pay of Rs 7,600 and graded as class A officers will be entitled to fly for out of the state for official business. Employees with a basic pay of Rs 6,600 and above will be entitled to fly with private operator flights within the state.
